User Agreement

Welcome and thank you for you interest in applying for the housing programs offered by the Housing Opportunities Commission of Montgomery County (H O C).When you use this website you are agreeing to our terms, so please take a few minutes to read over the User Agreement below.

Note: You are entering into a legally binding agreement.

1. Introduction

H O C administers a number of housing programs.By registering on this website, you will be placed on waiting lists for all of the housing programs for which you qualify. At the time you complete your initial registration, your application will be assigned a date/time stamp. As housing becomes available, applicants are selected from the list on a first come first served basis as determined by the date/time stamp and other criteria that are used to determine whether you qualify for housing opportunities.

Unless otherwise notified, the wait list will remain open to the public and you can access, review and update your application at any time.

Please be sure to save your registration password as you will need it to access your on-line application.

This electronic wait list website replaces all previous wait lists that were administered by H O C.

1.1 Purpose

Our mission is to responsibly connect families with housing opportunities.

1.2 Agreement

You also agree to our Privacy Policy, which covers how we collect, use, share, and store your personal information.

You agree that by clicking "Register", "Verify", "Update", accessing or using our services (including this website or our related mobile apps, or any content or information provided as part of these services, collectively, "Services"), you are entering into a legally binding agreement.

This "Agreement" includes this User Agreement and the Privacy Policy, and other terms that will be displayed to you at the time you first use certain features. If you do not agree to this Agreement, do NOT click "Register" (or similar terms) and do not access or otherwise use any of our Services.

Registered users of our Services are "Applicants" and unregistered users are "Visitors". This Agreement applies to both.

2. Obligations

2.1 Service Eligibility

Here are some promises you make to us in this Agreement:

To use the Services, you agree that: (1) you are at least 18 years of age or a minor that has been legally emancipated from a parent or guardian; (2) you will only have one registration profile, which must be in your real name and social security or alien registration number; and (3) you will truthfully report your family size, income, and other information requested herein.

2.2 Your Registration

You will keep your registration information and password secret.

You will not share your registration information and password and will follow our rules.

2.3 Wait List Selection Process

As housing opportunities become available, H O C will utilize the waiting list to identify families that are eligible for available housing. Applicants will be selected from the wait list based on: (1) assigned date\/time stamp (2) family income, size, and other factors determined by the type of housing available; and (3) any preferences afforded applicants as outlined in our Public Housing Admissions and Continued Occupancy Plan (ACOP) and Housing Choice Voucher (HCV) Administrative Plan. At the time you complete the registration process, your application will be assigned a date/time stamp that will remain effective for as long as your name remains active on the wait list.

If you fail to respond to the notice informing you that you may be eligible for a housing opportunity within the time period prescribed in the notice, your name may be removed from the wait list. You can register on the wait list site again. However, you will be assigned a new date/time stamp.

2.4 Notices and Service Messages

You agree that by registering with our website you will have access to mobile apps and/or SMS text messaging. You also agree that you may receive emails from us to provide you with important notices. This agreement applies to mobile applications as well.

H O C will notify you of possible housing opportunities based on the information you provide. You are responsible for providing complete and accurate contact information to us. If the contact information you provide is not up to date, you may miss out on these notices.

Furthermore, you will be required to update your application annually. H O C will send you messages via email, SMS text messages and other methods to remind you to update your application information. If you fail to provide updated information within the required time frame provided in any notice you receive, your application will be removed from the wait list and you will no longer be notified when housing opportunities become available.

You agree that we may provide notices to you in one of the following ways: (1) an email sent to an address you provided; (2) through other means including mobile number-text; and/or (3) by contacting the alternate contact person, via email, that you authorize to receive notifications on your behalf. You agree to keep your contact information up to date.

3. Service Availability

We may change our methods of administering this housing opportunities wait list. In the event that our methods of administering the wait list change, we will provide you notification using any of the communication methods described above, as well as through a public notice and comment period.

4. Disclaimer and Limit of Liability

4.1 No Warranty

This is our disclaimer of legal liability for the quality, safety, or reliability of our Services.

To the extent allowed under law, H O C (and those that H O C works with to provide the services) (A) Disclaim all implied warranties and representations (E.G. warranties of merchantability, fitness for a particular purpose, accuracy of data, and noninfringement); (B) Do not guarantee that the services will function without interruption or errors, and (C) Provide the service including content and information on an as is and as available basis.

Some laws do not allow certain disclaimers, so some or all of these disclaimers may not apply to you.

4.2 Limitation of Liability

By enrolling in, activating, using, or registering for the service, you agree that you have read this agreement and understand the limitations of the services described herein. To the maximum extent permitted by applicable law, under no circumstances will you be entitled to any indirect, incidental, consequential, special, punitive, or exemplary damages, regardless of the form of action, even if smartline has been advised of the possibility of such damages. Except for damages that are required by law to be paid, you agree that all damages are excluded except for the direct damages that are actually incurred by you in reasonable reliance, not to exceed the total amounts paid by you in the twelve months under this agreement immediately preceding the claim.

5. Dispute

In the unlikely event we end up in a legal dispute, it will take place in Maryland courts, applying Maryland law.

You agree that the laws of the State of Maryland, U.S.A., excluding its conflict of laws rules, shall exclusively govern any dispute relating to this Agreement and/or the Services. We both agree that all of these claims can only be litigated in the federal or state courts of Montgomery County, California, USA, and we each agree to personal jurisdiction in those courts.

6. General Terms

Here are some important details about how to read the Agreement.

If a court with authority over this Agreement finds any part of it not enforceable, you and H O C agree that the court should modify the terms to make that part enforceable while still achieving its intent. If the court cannot do that, you and H O C agree to ask the court to remove that unenforceable part and still enforce the rest of this Agreement. To the extent allowed by law, the English version of this Agreement is binding and other translations are for convenience only. This Agreement (including additional terms that may be provided by us when you engage with a feature of the Services) is the only agreement between us regarding the Services and supersedes all prior agreements for the Services.

If we do not act to enforce a breach of this Agreement, that does not mean that H O C has waived its right to enforce this Agreement. You agree that H O C may assign this Agreement to its affiliates or a party that buys it without your consent. There are no third party beneficiaries to this Agreement.

We reserve the right to change the terms of this Agreement and will provide you notice if we do and we agree that changes cannot be retroactive.. If you don't agree to these changes, you must stop using the Services.
